My mom is 75 and can no longer take care of her 103 yr old mother. My mom owns her own home and my grandmother was living with her. My grandmother fell was taking to the hospital and sent home with new onset of afib and on new medication. They refused to place her in short or long term care and delivered her to my moms home. the next day her breathing was bad and my mother was scared so we took her to another hospital in Boston . They admitted her, said she shouldn't have been discharged with new afib and new medications and needed to be placed in a rehab after being medically cleared. The social worker called my mom today to tell her they are discharging her mother on Wednesday because she can walk with a walker (that she refuses to use when she gets home) and can get in and out of bed by herself. My mom told them she can no longer care for her mother and she needs to be placed in a rehab. they threatened to charge her with abandonment. Can they do this and what can happen if she is charged.

If they deliver your mother they can be charged with abandonment and a multitude of medical malpractice. Have your mother write them an email, or send us mail overnight, certified return receipt! They are acting irresponsibly and trying to scare your mom into taking her back! Do you have an attorney that woukd be able to contact them to tell them this is against the law!

She doesn't have the money to hire one, she is only getting social security. But hopefully she can get free help. I just know my mom could not handle being charged and having to go to court for it. She has been through so much over the past years trying to take care of her.

They cannot release your grandmother from rehab without a place to go. Your mother must contact the social worker at the rehab and tell her that she cannot come home and must be placed in long term care. Tell them this tomorrow morning and contact an attorney. Who has a POA over this scenario?

They will not charge her. She has told them she can no longer provide the necessary care. You might want to call Adult Protective Services to tell them the situation. The social worker at the hospital sounds lazy. You talk to her, tell her that intimidation will not work with you mother and that you will contact the authorities!

Her mom is still in the hospital they won't put her in rehab because they feel she can go home. My brother and mother met with the social worker tonight and that's when they threatened her with abandonment. My mom has poa. I will have her call an attorney tomorrow. Thank you

Mince, she is in the hospital now, caregiver/daughter is 75, and can nolonger provide the care necessary! The social worker at the hospital is threatening to charge her with abandonment. Daughter/caregiver wants her in long term care or rehab at minimum!

Before calling an attorney you may want to try calling the Bar Association in your state. You may get quicker action and they have attorneys on lists that will do pro bono work. The hospital may have a reputation for this sort of intimidation. Let us know what happens.
