My wife was transferred from a nursing center in Manteca, CA to Stockton, CA without my knowledge for over 5 weeks. I didn't know where my wife was and after she was transferred the nursing center where she is now put her on lock down preventing her from calling me. Both nursing centers had my phone number. This caused emotional distress on us both. When I asked questions why I was ignored, I tried to consult with 5 attorneys already which all have denied help. I feel these nursing centers need to pay for what they did to my wife and I.

Find Care & Housing
Do you live in your own home or are you living in a facility? Do you have a cell phone, email, home phone in which the facility can contact you? Who is in charge of your wife's medical and financial issues?

Were you listed as the contact person? Were you listed on the HIPAA form as an authorized party to receive information? Do you have medical POA?

Unless they have explicit instructions to inform you of her condition, or ask your permission for any new treatments, or why and where they are transferring her, then they are not obligated to contact you.

If 5 attorneys have agreed that they can not help you, I think you have to let it go.

More info needed.

Did the State take over your wifes care? If so, she now has a guardian who is in charge of her care. Instead of hiring a lawyer to sue the facility, hire someone to find out what is going on. Why weren't you notified. You need answers why you were being kept away.

Is her Social Security still being sent to your accounts? If not, the State has probably been put in charge of her care.

Adult Protection Services may be able to help you find answers.

Is this perhaps a second marriage, one where your wife’s adult children remained in charge of her healthcare decisions through having Power of Attorney? I’m sorry for your hurt and trauma in this, but am glad you located your wife

The answer is, it depends.

Why was your wife there in the first place (need this info for context of your situation)? If she was cognitively impaired maybe she was telling the staff weird things about you and were protecting her. If you aren't her MPoA then maybe that's also why they didn't divulge info to you.

Or, they informed someone else in the family who showed up or she gave them their contact info.

If 5 attorneys reviewed your info and evidence then they unanimously agree you don't have a case. Therefore, there's nothing that we non-attorneys who are on an anonymous global forum with no accountability can do for you.

I guess my first question would be...why did it take you "over 5 weeks" to discover that your wife had been moved to a different facility? Had you not been visiting her that whole time and if not why not?
Something seems fishy here and not quite right, and I'm guessing because you're not telling us the whole truth, so why don't you back up and tell us the whole true story of what actually went down, and why.

That's pretty shocking. What was the reason given for this? How did you finally find her? What does your wife say about it? Who is paying for the nursing center -- are you paying privately, or is it Medicare or Medicaid?
