Now she is having people call my partner for her to go gets cats. Isn't she in violation of the dvop? I am seeing a lawyer in the morning.

Bother is 100 percent disabled, in wheel chair, limited speech due to a car accident at age of 21, now 67. He's afraid of her, she threatens to put him in a nursing home. She controls All his money.

cooter if you have a dvpo, you will not get the Baker Act results. No contact means you are cut off from everything. You cannot go back for the cats unless the police accompany you. They will only take you back there once, one trip to get your stuff, your cats and then no more.

It what way is your brother disabled? It sounds as though he is being abused. You can ask legal aid to have a guardian appointed for him, perhaps. Is he competent enough to file a complaint against her?

Still have not been given access to her baker acted results. Don't know how to get them. Yes, sheriffs know she shows signs of dementia. Apparently they must feel she is competent.DCF has been called to the home twice because of her slapping around my brother. They said all they can do is warn her. She laughed at that. This is Elder Abuse in reverse. I hate to think that Nothing will be solved unless someone is very seriously hurt.

If the sheriff's office won't do a wellness check specifically on your brother (they know your mom has dementia, yes?) then I would call Adult protective services and your local area agency on aging and explain that your brother is without a caregiver.

I take it that mom was found competent during her hospitalization?

Don't know, am Not allowed any contact. I called sheriffs office on a wellness check, they said if anything was wrong she could call 911. She wasn't taking care of him before this, so she isn't taken care of him now.

Is your brother being taken care of? Can the police do a well check on HIM?

I was in the process of packing and moving out, with the help of 2 other people. My mother attacked all of us, had to call sheriff who advised me to file a expate. I have the police reports. No abuse was done to her, yet that's what her and her lawyer are claiming in the dvpo, which is false. We were told by the sheriff for us Not to file abuse on her because 93 yr old people don't do well in jail. Yet when she got out of being baker acted 2 days later, they filed dvpo on me. All I was trying to do was move out. Now I can't get anything which she has threatened to destroy and I won't beable to prove otherwise. I also had to leave my two old cats which will not be taken care of. I will get a public defender, but what other recourse do I have?

You walk away and leave them alone and make no contact, for your own protection. You need a lawyer immediately to defend yourself against the Domestic Violence Protection Order (DVPO). If you have no money you get a public defender. Never go to court for charges this serious without good counsel.
