after getting my mom and dad approved for home care I used this agency and at first I thought this is how these works but I came to find they were wrong and they kept my hours, my pay was always late, they used to pay some cash and check. Since this was my only job and I was depending on this paycheck they made my life miserable. I couldn’t pay my bills on time I lost my apartment lost my car. Havnt received my tax for 2023. So I think all these things are connected with this agency because with the agency I am currently working. Everything is super smooth no late pay no wage theft and I get my full hours in my paystabs

You can file a report with your State's Department of Labor
You can also file a complaint with the U.S. Department of Labor.
However if your parents were approved for 80 hours of help that is all you will get paid for.

Were your parents approved for 80 hours of home care only? If so, that's why you were paid for 80 hours.

To me there are 2 different issues
- for the old agency that has been late &or incorrect on hours and paying you partially in cash, not submitting a timely IRS tax filings, you can file a complaint with your States Dept of Labor. States take wage theft pretty seriously. You will need to gather up all the paperwork from that period and do a timeline of days worked if you did not keep a calendar.
- Its not illegal to work a 80 hr week in the US. But I think there would be an issue with getting paid for an 80 hr work week if you are being paid via a State or Federal program to caregiver for 2 clients in the same household with your caregiver time paid overlapping; so getting paid twice for the same time slot. Was this happening? IF it was, that could be why there was a discrepancy btw hours actually worked vs. your thinking it was to be a full 80.

An 80:hr work week is really hard both mentally and physically. It’s not sustainable.

The paying you in cash thing sounds totally sketchy.
