In my state, simple probate of will and final closure usually happens in 6 months. However, final taxes of decedent must be paid prior to distributing inheritance. If decedent died in February of 2017, do the heirs have to wait until 2017 taxes are paid in 2018 before receiving inheritance (thus, dragging out process from 6 months to 1 year)?

That's an excellent question, newwidow. So sorry for your loss.

My Dad passed 10 months ago, and from what I have heard the case won't be finished until later this year, or early next year... and here I am the only heir.  And I am using an Elder Law Attorney to process this case.

Hopefully someone who has been through this and have received the distribution will give us some answers.

You can file the final taxes for the estate anytime in the rolling 12 months following the date of death - providing all the accounts have been closed and cashed out and are no longing creating revenue.  There is no need to wait for the traditional April 15th date.
