DSS handed me after assessing my mother. I'm working on her application for benefits and she has family land, will they take it from her? It's been in family 7 generations.

DSS handed you what after assessing your mother? Who requested the assessment?

Your mother is only 65, is that right? Could you say more about what the assessment said about her care needs, and when you arrived on the scene, and what you found when you got there.

What are you applying her for? I'd get a professional's opinion in your jurisdiction. Often, they look at income to determine eligibility, but, the person gets to keep their home...at least until they die, then, estate recovery would evaluate.

Who told you that you need a home health aide? Or is this a Visiting Nurse? They may feel Mom needs a medical professional to check in on her every week or so.

If the land is in your mother’s name, it is considered an asset and will have to be sold to self-pay for her care. When that is spent down, you apply for Medicaid.

Ask your state’s Medicaid Office for more help, or even en,it’s the help of an Elder Law Attorney.
