SheShe recently broke her hip and arm I asked my son to give permission so that the facility can we'll talk to me the facility said they can't do it it has to come from my wife the facility also falsely denies there is no incapacity thanks

If there is no incapacity, and you have no doctors letter saying there is incapacity, then your wife has a legal right to put her sons in charge of health care and her own private financial affairs. If you have been serving as her POA for some time due to incapacity now is the time to see your attorney if you suspect your sons of fraudulent or nefarious activities.

It seems like she is in a rehab facility due to her broken hip and arm, correct?

Are you referring to the HIPAA Medical Representative form? Or a MPoA document? Is her being demented proven by a formal diagnosis by a doctor? If not, you may have trouble with this situation... the rehab facility is not where a diagnosis for that will be made.

What is your main concern about not having permission to talk about her to the facility staff? Are you worried she'll get released (or check herself out) and go back home where she will continue to fall? Are you burnt out has her caregiver? Is she a danger to herself or others?

Can you talk to your sons about what's going on with your wife's situation at rehab? Your sons will find out soon enough whether they can handle this responsibility.

More information would be helpful.

If your wife has a sound mind she can choose anyone she wants to view medical records or speak about her healthcare. If she does not have a sound mind, can you produce prior documentation that shows her mental capacity of dementia and her stated wishes before the diagnosis?
