Dear Elsie,

I would check with an elder law or real estate attorney about how to remove your mom's name and only have your name and your husband's name on it. If you have the paperwork showing you fully paid your mom for the house, an attorney might be able to change the deed.

Elsie, you wrote you bought you bought Mom's share share of the house. Was the price of the house at current market value or did Mom give you a discount. Was a Quit Claim form use and no money passed? Usually when houses change hands when money is involved, a Title Company or Real Estate Attorney handles the transaction, thus your Mom's name would have been removed, and your name be placed on the Deed.

Now, here is where it can become tricky. What if your Mom needs to apply for Medicaid [which is different from Medicare].... Medicaid will do a 5 year back paper trail on the finances. They will see that Mom sold her 1/2 share of the house. What did Mom do with the money? Was the house sold at current market value?

I agree with cdnreader above, go see an Elder Law Attorney or Real Estate Attorney to make sure all your ducks are in a row.
