Wondering the best strategy for my family. My mother could buy the house soon once we figure out its value? We may need to pay for the nursing home for a month with money grandma don’t have? Loan with promissory note? Timing?


Is there an option here for my mother to be gifted the house? Then give a loan to my grandmother for half its value? The Half loaf plan?


My grandmother owns a mobile home that is on a lot owned by my mother.


Has only enough money to prepay for the rest of the month then go on Medicaid.


Is in a nursing home in Indiana.


Home is in Kentucky and has lived there for her life.


Nursing home wants private pay until Medicaid is paid due to policy. She wants to stay in this facility.

See a lawyer. You will need one anyway, to put any of these options into place. Your grandmother may not have much ‘cash money’, but it sounds as though she has valuable assets.

You badly need the advice of an elder law attorney about best options. Please see one as soon as you can. These questions have SERIOUS legal repercussions and you cannot guess at them nor have the "opinions" of various people around the country. You need the legal advice of an Elder Law Attorney in your own area. Best of luck moving forward and getting your options.

The issue partly it the mobile homes value is only 25K and moving it cost nearly that much. So we might be looking at enough money for one month in a nursing home if we dont give it all to any attorney.

Alva, this question is about how to take over GM’s assets and then apply for Medicaid after paying for one month. I’m not sure that ‘best of luck’ is appropriate?

A trailer is not worth much and it has to sell for Market Value. There is no gifting or partial value. It has to be sold at Market Value. And those proceeds all go to grandmoms care. You need to get that Medicaid application started now. Moms home is an exempt asset at this point. Her SS and any pension needs to be turned over to the NH to help offset the cost of her care. My Mom had 20k. All she had was her house. I started the Medicaid application in April. Mom went into care May 1st and paid for May and June privately. June I confirmed that the Medicaid had all info needed and July Medicaid started paying. The faster you get the info needed to Medicaid, the faster you will get Medicaid. You may need a lawyer just for the purpose of finding out if you don't pay privately, will Medicaid retro the payment to cover the time grandmom was in care. They will not kick geandma out. It would be considered an unsafe discharge. You need a lawyer to protect her rights.

If home is in a different state it is NOT exempt for Medicaid. Nursing home in Indiana and home in Kentucky. Need an elder lawyer to sort out in Indiana

What is the Medicaid app "look back" period for your Grandmother's home state (Kentucky)? It's probably 5 years... the house transfer/purchase should have happened 5 years ago...too late now. Hopefully other transactions that appear as "gifting" have not been happening, either.

Please see an elder law attorney or estate planner or Medicaid Planner for Kentucky to know what Grandma should or shouldn't be doing at this point in time. I would not risk getting advice from this anonymous global forum where there is no accountability. You don't want to do anything that will delay or disqualify her at this point. The money spent on a professional will be worth it.
