My mother lives in Texas. She has dementia. Congestive heart failure,has fallen several times and due to that has fractures in her lower back. I live in Pennsylvania and have power of attorney. She is moving in w/ my sister in Florida and I need to sell the home so that my sister will be able to hire someone to help w/ my mothers care. Can I sell the house if w/ out hiring an attorney. It would be one more expense we cannot afford.

If you have an active POA for finances (mother declared incompetent to serve as own agent), you should be able to put her house on the market. If you talk to a realty company representative, they will know what you need to do to make sure the sale is legal. You shouldn't have to hire a lawyer except to do the closing. Unless something goes terribly amiss, all ducks will have to be in a row before the the sale can be closed. Real estate agents have probably dealt with situations like this many times and will be excellent sources of advice to make things go smoothly.
